New Spanish Regulation: Simplified Vessel Export Process

Spanish Customs office has announced a new change in their interpretation of what they consider “Leaving the EU”. From now on, leaving more than 12 nautical miles can be considered as enough to export your vessel.
There are a lot of advantages in this new procedure as the visit to non EU port is now not compulsory.

Prior to this new interpretation, your departure to more than 12 nautical miles offshore was only valid to close your TPA (or IPR) regime, and you needed to visit a non-EU port to apply for certain Customs regimes as for example a renewal of your temporary admission.

After this news, you will be able to use the abovementioned method to apply for different Customs regimes. The main regimes affected by this change are the following:

  • Temporary admission renewal (Annex 71.01)
  • Vessels non-EU sale to non-EU owner – international waters sale

What are the changes for Temporary Admission (Annex 71.01)?

When you wanted to renew your 18-month stay period in the EU, you had to navigate to a non-EU port and get the corresponding stay proof (such as practique note in Gibraltar or Algiers port clearance document). Once you had this document, you had to return to Spanish waters and apply for a new Annex 71.01 in your first port of entry to renew your temporary admission period.

Now, we can issue an official exportation document request to Customs prior your departure so you can leave for more than 12 nautical miles and, once you provide proof of this departure (pictures of the plotter with the Certificate of Registry of the vessel appearing too and pictures of the vessel’s logbook showing the route you have made), we will be able to close your exportation and then come back to a Spanish port and immediately apply for a new Annex 71.01 temporary admission renewal, restarting your 18-month temporary importation period once you get green light from Customs officers.

What are the changes for sales in international waters?

Prior to this change, sale was not completed as finalized until you were able to provide a proving document showing that the vessel has arrived into a non-EU country, after this change, the proofs mentioned before (pictures of the plotter with the Certificate of Registry of the vessel appearing too and pictures of the vessel’s logbook showing the route you have made) will suffice to finish your exportation.
